These Terms of Service (the “Terms”) govern your access to and use of the MaxFit mobile application, website, and related services (together, the “Platform” or “MaxFit”), operated by MaxFit Technologies FZ-LLC (“MaxFit”, “we”, “us”, or “our”). By creating an account, subscribing, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use MaxFit.
1. Acceptance & eligibility
You must be at least 18 years old to hold a MaxFit account and enter into a paid subscription. If you are between the applicable minimum digital-consent age and 18, you may only use MaxFit under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By using MaxFit you represent that the information you provide is accurate and that you have the legal capacity to accept these Terms.
2. What MaxFit provides
MaxFit is a single platform offering two consumer products:
- MaxFit AI — a voice-first AI coaching companion that generates fitness plans, nutrition suggestions, recipes, and personalised guidance, plus optional access to a marketplace of independent human coaches.
- Maxi Gyms — a QR-based network that lets subscribed members scan to enter participating partner gyms under a single membership.
Features, coaches, gyms, and content available on the Platform may change, expand, or be discontinued over time. We do not guarantee that any specific coach, gym, recipe, or feature will remain available.
3. Your account
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must notify us promptly at support@maxfit.io if you suspect unauthorised use.
- A single consumer account may hold additional roles (for example Coach or Gym Owner) subject to separate approval and the relevant role terms.
- You may not share, sell, or transfer your account, subscription, or gym-entry QR credentials to any other person.
4. Subscriptions & payment
Access to paid features requires an active subscription. Plans, bundles, renewals, and pricing are described in our Subscription Terms & Conditions and Pricing & Billing Policy. Payments are processed securely by our third-party payment processor, Dodo Payments; MaxFit does not store your full card details. Refunds and cancellations are governed by our Refund & Return Policy and Subscription Cancellation Policy.
5. AI-generated content
Certain MaxFit features use artificial intelligence to generate plans, recommendations, recipes, and conversational responses. AI output can be inaccurate, incomplete, or unsuitable for your circumstances. You are responsible for evaluating AI-generated content before acting on it. Your use of AI features is governed by our AI Usage & Disclaimer Policy.
6. Acceptable use
You agree to use MaxFit only for lawful purposes and in line with our User Responsibility & Acceptable Use Policy. Among other things, you must not misuse the QR scan system, attempt to gain unauthorised gym access, reverse-engineer the Platform, upload unlawful content, or interfere with the service's security or integrity.
7. Coaches, gyms & the marketplace
Independent coaches and partner gyms are third parties, not employees or agents of MaxFit. We facilitate discovery, booking, and (for gyms) entry, but we do not control and are not responsible for the services, premises, safety, conduct, or advice of any coach or gym. Any coaching engagement or gym visit is at your own risk and subject to the coach's or gym's own terms and applicable safety rules.
8. Intellectual property
The Platform, including its software, design, trademarks, and content we provide, is owned by MaxFit or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your personal, non-commercial use in accordance with these Terms. You retain ownership of content you submit (such as profile data and messages) and grant us a licence to process it to operate and improve the Platform, as described in our Privacy Policy.
9. Disclaimers
To the maximum extent permitted by law, the Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of AI output, or uninterrupted availability. Nothing in these Terms excludes or limits any rights you have under the mandatory consumer-protection laws of the United Arab Emirates, which continue to apply.
10. Limitation of liability
To the maximum extent permitted by applicable law, MaxFit and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on AI-generated content, fitness or nutrition guidance, coach services, or gym access. Where liability cannot lawfully be excluded, our total aggregate liability to you is limited to the amount you paid to MaxFit in the twelve (12) months preceding the event giving rise to the claim. This clause does not affect your statutory rights under UAE consumer-protection law — see our UAE Compliance & Consumer Protection page.
11. Indemnity
You agree to indemnify and hold MaxFit harmless from claims, damages, and expenses arising out of your misuse of the Platform, your breach of these Terms, or your violation of any law or third-party right.
12. Suspension & termination
We may suspend or terminate your access if you breach these Terms, misuse the scan system, or pose a risk to other users, coaches, or gyms. You may stop using MaxFit and cancel your subscription at any time as described in our Cancellation Policy. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Platform or by email before they take effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
14. Governing law & disputes
These Terms are governed by the federal laws of the United Arab Emirates and, where applicable, the laws of the Emirate of Dubai. Any dispute that cannot be resolved amicably will be subject to the competent courts of Dubai, United Arab Emirates, without prejudice to any mandatory consumer rights that entitle you to bring proceedings elsewhere.
